Terms of Service

Please read these terms carefully before using Testimonio.

1. Who We Are

Testimonio LLC (“Testimonio,” “we,” “us,” “our”) operates the testimon.io website and the Testimonio mobile application (together, the “Services”). These Terms of Service (“Terms”) are a legal agreement between you and Testimonio LLC. By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Eligibility (13+ Age Requirement)

You must be at least 13 years old to use the Services. The mobile app enforces a 13+ confirmation during onboarding. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently collected information from a child under 13, please contact privacy@testimon.io and we will delete it.

3. Accounts

You can use the Services without signing in. If you choose to sign in, you do so via Sign in with Apple or Sign in with Google. You are responsible for maintaining the confidentiality of the device you use to access the Services. You may delete your account at any time from Settings > Privacy in the mobile app, or by emailing support@testimon.io.

4. Your Content and Ownership

Journal entries, Lectio Divina reflections, prayers, and any other personal text you write inside the Services are yours. They are stored only on your device and are never transmitted to or stored on our servers. You own them; we have no license to, no rights in, and no copy of them. If you delete the app or your device, your personal content is permanently gone.

If you voluntarily send us feedback, suggestions, or ideas by email or support channels, you grant us a non-exclusive, royalty-free, perpetual license to use that feedback to improve the Services.

5. Subscriptions and Payments

Testimonio offers optional premium subscriptions, billed through Apple’s App Store or Google Play. All billing, renewals, refunds, and cancellations are handled by the platform you purchased through. We do not process credit cards ourselves. Subscription terms, pricing, and renewal periods are disclosed at the point of purchase in the mobile app. You can cancel at any time through your Apple ID or Google Play account settings.

6. Acceptable Use

You agree not to: (a) use the Services to violate any applicable law; (b) interfere with or disrupt the integrity or performance of the Services; (c) attempt to gain unauthorized access to the Services or related systems; (d) reverse engineer, decompile, or disassemble the Services except to the extent applicable law permits; (e) use the Services to transmit malicious code; (f) misuse referral or invite features to spam others.

7. Religious and Spiritual Content

The Services provide Christian meditation, Scripture reflection, and devotional content. This content is offered for spiritual encouragement and education only. It is not, and must not be treated as, medical advice, mental health treatment, legal advice, financial advice, or any kind of professional counsel. If you are in crisis or need professional help, please contact a qualified provider. Testimonio makes no warranty or representation as to any particular spiritual outcome.

8. Intellectual Property

The Services, including all text, graphics, audio, video, meditation scripts, blog posts, and software, are owned by Testimonio LLC or its licensors and are protected by copyright, trademark, and other laws. You may use the Services for your personal, non-commercial use. You may not copy, modify, distribute, sell, or lease any part of the Services without our prior written consent.

9. Third-Party Services

The Services rely on third-party providers (Apple, Google, Supabase, RevenueCat, ElevenLabs, Mixpanel, Sentry, MailerLite, Vercel) for hosting, authentication, payments, and analytics. Our Privacy Policy lists them. Those providers are governed by their own terms; we do not control their practices.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL TESTIMONIO LLC OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Testimonio LLC and its officers, directors, employees, and agents from any claim, demand, loss, or liability (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms, your misuse of the Services, or your violation of any law or the rights of any third party.

13. Binding Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services (a “Dispute”) will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act governs the interpretation and enforcement of this provision. The arbitration will be conducted in English in San Francisco, California, or, at your option, via video conference or in your home state. Judgment on the award may be entered in any court of competent jurisdiction.

YOU AND TESTIMONIO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Testimonio agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.

You may opt out of this arbitration agreement by sending written notice to privacy@testimon.io within 30 days of first accepting these Terms. Opting out will not affect any other provision of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Subject to Section 13, any judicial action permitted by these Terms will be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to the jurisdiction and venue of those courts.

15. Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we reasonably believe violates these Terms or is harmful to the Services, other users, or us. Sections 4, 8, 10–14, and 17 survive termination.

16. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms with an updated “Last updated” date. Continued use of the Services after the effective date constitutes your acceptance of the revised Terms. If a change is material, we will make reasonable efforts to notify you in-app or by email (if you are subscribed to our communications).

17. Miscellaneous

These Terms, together with the Privacy Policy, are the entire agreement between you and Testimonio regarding the Services. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right or provision of these Terms is not a waiver of that right.
